These terms govern your use of Wend. They cover what the app is and is not, how the Premium subscription works, and where responsibility sits. Please read section 3 in particular — it is about riding safely.

Wend is developed and published by Toan Nguyen, an individual developer based in Singapore ("we", "us", the "Developer"). By downloading, installing or using Wend (the "App"), you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use the App.
You must be at least 13 years old, or the minimum age of digital consent in your country, to use Wend. If you are under 18, you should review these terms with a parent or guardian.
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use Wend on Apple-branded devices you own or control, in accordance with the Apple Media Services Terms and Conditions and the Usage Rules set out there. This licence is for your own non-commercial use.
You may not sell, sublicense, rent or redistribute the App; reverse engineer, decompile or disassemble it except where that restriction is prohibited by law; or remove any proprietary notices from it.
Do not operate your phone while cycling. Start your trip before you set off and stop it after you have come to a halt. Wend is designed so that a recording continues while your screen is off; there is no reason to look at your device mid-ride.
You are solely responsible for your own safety and for the safety of people around you. That includes obeying traffic law, wearing appropriate protective equipment, riding within your ability, staying aware of your surroundings, and assessing weather and road conditions. Nothing the App displays — a route, a path overlay, a speed, a heart rate — overrides your own judgement or the instructions of a traffic authority.
Wend is not a navigation system. It records where you have been; it does not tell you where to go, and it does not know whether a road is safe, open, one-way, closed, or suitable for cycling.
Consult a physician before beginning any new exercise programme, particularly if you have a heart condition or have been inactive.
Wend derives distance, speed, elevation and route shape from your device's GPS hardware. GPS is inherently approximate. Accuracy degrades under tree cover, between tall buildings, in tunnels and car parks, in poor weather, and when your device is low on battery or in Low Power Mode. Wend filters out obviously implausible readings, but it cannot manufacture accuracy that the hardware did not provide.
Heart rate figures come from Apple Watch sensors and carry the same caveat. Wend is not a medical device. It is not intended to diagnose, treat, cure or prevent any disease or condition, and no figure it displays should be used to make a medical decision.
Trip records are stored on your device. Premium riders can also enable automatic copies of trip history in their private Apple iCloud through Wend's iCloud Backup feature. Those copies exclude heart-rate samples and HealthKit workout identifiers, which remain on the device or in Apple Health and cannot be restored from Wend's iCloud Backup. No backup is infallible. We are not responsible for trip data lost through device loss, damage, theft, an operating system fault, running out of storage, deleting the App, an unavailable or deleted backup, or the App being terminated by iOS while a recording is in progress.
Wend is free to use for recording, viewing and sharing trips. Wend Premium is an optional auto-renewing subscription that unlocks additional features and removes advertising.

Payments and refunds are handled entirely by Apple. We never see your payment details and we cannot issue refunds ourselves. Refund requests go through reportaproblem.apple.com and are decided by Apple under the Apple Media Services Terms and Conditions.
If the price changes, Apple will notify you and, where required, ask you to consent before the new price applies. We may add, change or withdraw Premium features over time; if a change materially reduces what Premium offers, we will say so in the App before it takes effect.
Restoring a purchase. If you reinstall Wend or move to a new device, use "Restore Purchases" on the subscription screen. Your entitlement is tied to your Apple Account, not to your device.
On the free tier, Wend displays advertising supplied by Google AdMob. Ads are clearly marked and are never shown in a way intended to be mistaken for app content. We do not control which specific ads you see and we do not endorse any advertised product or service; any dealing you have with an advertiser is between you and them.
Subscribing to Wend Premium removes advertising entirely — the ads SDK is not started at all for subscribers. What data advertising involves, and how you control it, is set out in our Privacy Policy.
Your trips are yours. We claim no ownership over the routes you record, the names you give them, or the share cards you generate. Complete trip files stay on your device. If Premium iCloud Backup is enabled, a copy excluding heart-rate samples and HealthKit workout identifiers is stored in the app's private CloudKit database in your Apple iCloud account. The Developer cannot browse that private database and claims no licence to use your trip data.
When you export or share a trip image, you are publishing it yourself, to a destination you choose, and you are responsible for what it reveals. Route maps can disclose where you live and work — consider that before posting one publicly.
Maps, map tiles and geocoding are provided by Apple Maps, and Premium iCloud Backup uses Apple's private CloudKit database. These services are subject to Apple's terms. Apple's map data may be incomplete or out of date in any given area.
Cycling path and park connector overlays are derived from datasets published by the Government of Singapore through data.gov.sg, made available under the Singapore Open Data Licence version 1.0. These datasets are provided on an "as is" basis. Neither the Government of Singapore nor we warrant their accuracy, completeness or currency, and neither is liable for any loss arising from their use. Overlay coverage is limited to Singapore.
Privacy-limited app usage analytics and crash diagnostics are processed by Google LLC through Firebase Analytics and Firebase Crashlytics, and advertising is served through the Google Mobile Ads SDK, subject to Google's own terms and policies. Do not use Wend to break the law, to record or track another person without their knowledge and consent, to interfere with the App's operation or security, to attempt to circumvent subscription controls or advertising, or to build a competing product from its behaviour or data formats.
Wend — including its name, icon, interface design, artwork, typography and source code — is owned by the Developer and protected by copyright and other laws. These terms grant you a licence to use the App; they do not transfer any ownership. The Nebula typeface and any other third-party assets bundled with the App remain the property of their respective owners and are used under licence.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY MEASUREMENT IT PRODUCES WILL BE ACCURATE.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing here limits any statutory consumer right you have that cannot lawfully be excluded — including, in Singapore, rights under the Consumer Protection (Fair Trading) Act.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP — INCLUDING PERSONAL INJURY OR PROPERTY DAMAGE SUSTAINED WHILE CYCLING OR OTHERWISE USING THE APP, AND INCLUDING LOSS OF RECORDED TRIP DATA.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) TEN SINGAPORE DOLLARS.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded.
This agreement is between you and the Developer, not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App.
If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund your purchase price if applicable; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple is not responsible for addressing any claim by you or a third party relating to the App, including product liability claims, claims that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or privacy law.
In the event of a third-party claim that the App infringes intellectual property rights, the Developer — not Apple — is responsible for its investigation, defence, settlement and discharge.
Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, will have the right to enforce them against you as a third-party beneficiary.
You represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any US Government list of prohibited or restricted parties.
We may update these terms as the App develops. The "Last updated" date above will change, and for material revisions we will surface a notice in the App. Continuing to use Wend after an update means you accept the revised terms.
We may modify, suspend or discontinue the App or any feature at any time. You may stop using Wend at any time by deleting it. Deleting the App removes local trip data but may leave a private iCloud backup; use Delete iCloud Backup in Wend Settings first if you also want that copy removed, as described in the Privacy Policy. Sections 4, 10, 11, 12 and 13 survive termination.
These terms are governed by the laws of the Republic of Singapore, without regard to conflict of law principles. Disputes shall be subject to the exclusive jurisdiction of the courts of Singapore, except where the mandatory consumer protection law of your country of residence gives you the right to bring proceedings in your local courts.
